Fee Transparency - Pricing List & Costs:

At Wainwright and Cummins LLP, we understand that cost is an important factor when choosing a solicitor. However, we firmly believe that price should not come at the expense of quality service and legal expertise.

Over recent years, there has been an increasing emphasis on pricing rather than the standard of work expected from a solicitor. According to publication in the Law Gazette, consumer advocates have expressed concerns that regulatory focus on price transparency has overshadowed the importance of service quality.

Our goal is to provide a balance—offering transparent pricing while maintaining high professional standards.

With the transition to a Fixed Cost Regime in litigation, solicitors must carefully consider the fees charged to clients while ensuring the quality of work remains uncompromised. Our priority is to provide excellent service that reflects the true value of your investment.

We do not pay for referral and most of our work comes from existing clients and referrals and the usage of third party website. We also  can be found on search engine sites as well on social media websites.

We take pride in offering personalised service, direct solicitor access, and a commitment to reducing stress throughout the legal process.

We always recommend to clients that you contact us about the costs of your matter. We are happy to discuss anything you need when instructing us, as all clients will have their individual needs and circumstances. However, the figures below will hopefully assist you in getting a general overview of the costs involved.

If you do decide to instruct us, we will give you a personalised quote for your matter at the outset. We will also regularly update any with any changes to our original quote during your instruction. In some instances we are able to charge a fixed fee for the work undertaken to assist in providing you with certainty of our costs. This will of course depend on the practice area and complexity of your matter.  

We will discuss either option with you at the outset and before any work is undertaken

 

Conveyancing fees:

For properties valued up to £1,000,000, our estimated legal fees range from £1,100.00 – £3,000 plus VAT (currently 20%).
Additional costs include: Bank transfer fee: £45.00 + VAT (£9.00)
Electronic Anti-Money Laundering (AML) / Identity Check: £24.00 + VAT (£4.80 per check)
Land Registry official copy documents: Approx. £15.00

Total Estimated Costs:

Lower range: £1,417.80 (including VAT and disbursements)
Upper range: £3,697.80 (including VAT and disbursements)

For properties valued over £1,000,000, the estimated legal fees range from £3,500 – £5,000 plus VAT.

Lower range: £4,297.80 (including VAT and disbursements)
Upper range: £6,097.80 (including VAT and disbursements)

Fee Structure: Our charges reflect the complexity and value of the property transaction. Fees are calculated based on an hourly rate of £150.00 plus VAT for lower-value properties and up to £261.00 plus VAT for higher-value or complex transactions. If you provide specific details of your property, we will confirm the applicable rate.

Disbursements: Disbursements are costs paid to third parties on your behalf, such as Land Registry fees. We will manage these payments for you. Disbursement costs will vary depending on the transaction details.

Additional Considerations:

Extra fees may apply for more complex cases, including probate-related sales, divorce-related transactions, or sales involving court proceedings.
Leasehold properties may require additional payments to landlords or managing agents, which will be outlined once details are available.
If the transaction does not complete, work completed and expenses incurred will remain chargeable.
VAT is calculated at the prevailing rate at the time of the transaction.
Additional fees may apply for dealing with lenders, surveyors, or any unforeseen complexities.

Conveyancing Process Overview: Our fees cover all work required to complete the sale of your property, including the repayment of your mortgage and any other charges registered against your property

The standard conveyancing process includes:

1. Taking your instructions and providing initial advice.
2. Reviewing the title and any other relevant documents.
3. Making necessary enquiries and liaising with third parties.
4. Preparing final contracts and facilitating the exchange.
5. Managing completion and post-completion formalities.

Estimated Timeframe: The typical conveyancing process takes between 8 and 16 weeks, though this can vary depending on the complexity of the sale and external factors. Leasehold transactions requiring lease extensions may take significantly longer (6-12 months or more), with additional charges applying in such cases.

Factors Affecting Costs: Several factors can influence the overall cost of your transaction, including:

Property value, lenders requirement where mortgage finance is required
New build properties or first registration of title
Additional legal complexities such as shared ownership, help-to-buy schemes, auctions, or repossessions

Fixed fee Divorce package

Fixed fee Divorce Package - Fee Transparency

- Applicant costs: £1,250 + VAT at 20% (£1,500 including VAT) plus court fee** (£593) and disbursements*. 
- Respondent costs (uncontested): £500 + VAT at 20%.

Please note a fixed-fee divorce is only suitable in uncontested divorces; where there are complex issues an hourly rate will apply and will be based on the nature and complexity of the issues.  Please contact us for a quote.

Divorce matters will be undertaken by Linda Sylvanus - Chartered Legal Executive (FCilex) or Rosalind Brown - Associate Solicitor and Partner of the Firm.

Financial Remedies and Child Arrangements:

- If there are financial or child arrangements to resolve, an hourly rate will apply and will be based on the nature and complexity of the issues.  Please contact us for a quote.
- If agreement has already been reached and a Consent Order is required, we can offer a fixed fee starting at £1500 + VAT at 20% + court fee**.

Estimated Timeframe
On average, a divorce takes between six and eight months to complete.  However cases veray from matter to matter and can fall outside this time frame.

Eligibility
A fixed-fee divorce is only suitable when there are no financial or child arrangements to resolve. Complex cases are not eligible for this model.  

*Disbursements
It is not possible to accurately predict all possible disbursements, but those that most frequently apply include the use of a process server to personally deliver the application to your spouse (when they have failed to acknowledge receipt with the Court), and an additional court fee when applying for permission to proceed with an alternative form of service. Disbursements attract VAT

Motoring Offences Fees:

Hourly Rates Based on Experience

The fees charged are based on the experience and qualification of the solicitor handling your case. Our hourly rates are as follows:

- Partner/ Member Solicitor: £275 per hour + VAT (20%) – (Including VAT £330)
- Senior Solicitor (8+ years): £250 per hour + VAT (20%) – (Including VAT £300)
- Assistant Solicitor (3-7+ years Experience): £200 per hour + VAT (20%) – (Including VAT £240)
- Paralegal or Trainee Solicitor: £150 per hour + VAT (20%) – (Including VAT £180)

These rates are subject to change, and we will notify you of any updates before commencing work.

Fixed Fees for Motoring Offences

We also offer fixed fees for certain stages of representation. These fees include VAT unless specified otherwise.

1. Initial Consultation
- Duration: Up to 40 minutes
- Fee: Free of charge

2. Making Representations or Mitigation by Post
- Fee: £275 + VAT (20%) - (Including VAT £330)
- Includes: Reviewing evidence, preparing written submissions, and corresponding with the court.

3. Guilty Plea Representation
- Fee Range: £500 - £750 + VAT (20%) – (£600 - £ 900)

Includes:
- Reviewing evidence
- Taking your instructions
- Providing advice on likely sentencing
- Attendance and representation at a single Magistrates’ Court hearing

4. Not Guilty Plea – Trial Representation
- One-Day Trial: £2,000 + VAT (20%) + disbursements  - (£2400 + disbursements)
- Full-Day Trial: £3,000 + VAT (20%) + disbursements – (£3600 + disbursements)

Includes:
- Review of evidence and preparation of your case
- Taking witness statements
- Advice on defence strategy
- Attendance and representation in court
Additional costs for expert witness fees and specialist reports may apply (see below).

5. Exceptional Hardship Applications

Fee: £650 + VAT (20%) – (£780 including VAT)

Includes:
- Preparation of your case
- Representation at the Magistrates’ Court hearing to retain your licence

6. Special Reasons Arguments

Fee: £800 + VAT (20%) – (£960 including VAT)

Includes:

- Preparation and submission of your argument
- Representation at court

In some cases, additional costs may apply. These are charged separately and will always be discussed with you in advance. Examples include:

- Expert Reports: Costs vary depending on the nature of the report and the expert’s fees.
- Travel and Mileage: 45p per mile + VAT (20%) and standard parking fees.
- Court Disbursements: Fees imposed by the court, such as filing fees.

Timescales

We aim to handle all matters efficiently, but timescales are subject to court availability and case complexity. For guilty pleas, we typically anticipate attending court for half a day. For trials, preparation and attendance will take longer depending on the evidence and witnesses involved.

VAT Information

All fees are quoted exclusive of VAT unless otherwise stated. VAT is charged at the standard rate of 20%.

We are a legal aid firm and will often offer our clients who are from a low income to see if they are entitled to assistants. Legal aid is for those who need legal assistance but you do not earn enough to pay for a Solicitor. Legal Aid may help meet the costs of legal advice, family mediation and representation in a court or tribunal.
